Disclaimer: Wir haben nach bestem Wissen und Gewissen recherchiert, aber letztlich ist unsere These, die wir aus unseren Rechercheergebnisse gezogen haben, eine Vermutung. Um unsere Thesenbildung transparent zu machen, legen wir unsere Quellen und Rechercheergebnisse offen.

Vermutlich plant Akelius mit drei Schritten in einem Mega Deal mehrere tausende Wohnungen in Hamburg und Berlin zu verkaufen, flankiert von einer gewaltigen Steuervermeidung und der Abführung der Gewinne nach Kanada.

Schritt 1: Akelius verrechnet durch die Verschiebung von Häusern in GmbH & Co. KG’s Verluste mit Gewinnen und verbucht gleichzeitig steuersparend die „stillen Reserven“.

Schritt 2: Anschließend verkauft Akelius in einem Mega Deal diese Häuser, ohne vorherige weitere Investitionen oder Umwandlung in Eigentumswohnungen.

Schritt 3: Dadurch reduziert Akelius seinen Bestand in Berlin und Hamburg drastisch und expandiert mit den Gewinnen nach Nordamerika, vorrangig nach Kanada.

An Akelius lassen sich alle Missstände und Mängel im Mieter*innen-Schutz aufzeigen. Erst kauft Akelius Häuser großflächig im Share Deal und umgeht damit das bezirkliche Vorkaufsrecht in den Milieuschutzgebieten. Dann verfolgt Akelius systematisch die Vernichtung preiswerten Wohnraums durch die dauerhafte Verschiebung der Wohnungen ins Luxussegment. Nun wandelt Akelius entweder Mietwohnungen in Eigentumswohnungen um und verkauft sie zu Höchstpreisen oder verkauft sie in einem Mega-Deal an einen anderen Spekulanten weiter. Nichts von alledem ist im Interesse von uns Mieter*innen.

Für Städte wir Berlin oder Hamburg ist Akelius ein massives Problem. Durch die ausschließlich am Profit orientierte Geschäftspraxis von Akelius werden administrative Instrumente zum Schutz von Mieter*innen und der städtischen Infrastruktur ausgehebelt. Durch die zusätzliche systematische Steuervermeidung im Geschäftsgebaren von Akelius entgehen den Städten und den Verwaltungen Millionen Euro, die notwendig sind um einen Stadt am Laufen zu halten. Das heißt, zum einen belastet Akelius die Sozialkassen der Städte, indem Akelius die Mietpreise anheizt, wodurch Mieter*innen zunehmend auf Transferleistungen angewiesen sind, um die steigenden Mieten zahlen zu können. Und gleichzeitig verweigert Akelius durch Steuertricks die Zahlung von Steuern, die die Städte für ihre Sozialausgaben benötigen.

Politisch lässt sich am Beispiel von Akelius veranschaulichen, dass große private börsennotierte Immobilienkonzerne viel zu viel Macht besitzen. Mit ihren riesigen Beständen und durch das Hin- und Herschieben ganzer Stadtteile betreiben sie Stadtentwicklungspolitik, dabei ist aber genau das die originäre Aufgabe von Politik und Verwaltung. Es braucht dringend wirksame Instrumente gegen diese großen profitorientierten Konzerne. Wohnen ist ein Menschenrecht und fällt in den Bereich der Daseinsfürsorge, die grundsätzlich nicht privatwirtschaftlich sondern am Gemeinwohl orientiert betrieben werden sollte.

Forderungen

Wir fordern von der Politik, diesen Akelius-Mega-Deal nicht zuzulassen, sondern alle Häuser in den kommunalen Wohnungsbestand zu übernehmen!

Wir fordern den sofortigen Stopp aller laufenden Umwandlungen und das ausnahmslose Verbot der Umwandlung von Miet- in Eigentumswohnungen!

Wir fordern die Ausweitung des kommunalen Vorkaufsrechts auch auf Nicht-Milieuschutzgebiete und insbesondere das Recht zum preislimitierten Vorkauf!

Wir fordern die ausnahmslose Schließung aller Steuerschlupflöcher sowie die konsequente Prüfung aller bisherigen Akelius-Share Deals und die Strafverfolgung nachgewiesener fingierter Akelius-Share Deals!

Wir fordern einen konsequenten Mieter*innenschutz mit dauerhaftem Mietendeckel und der Vergesellschaftung von Akelius im Rahmen der Kampagne „Deutsche Wohnen & Co. enteignen“!

Wir fordern die Gewährleistung aller Mieter*innenrechte und die Schaffung von Transparenz im Wohnungs- und Finanzmarkt durch die Einführung eines Wohnungs- und Mietenkatasters!

Wir fordern das Menschenrecht auf Wohnen endlich in die Praxis umzusetzen!

Stop This Mega Deal!

Take homes into municipal ownership!

Disclaimer: We have researched to the best of our ability, but ultimately our hypothesis, while research-based, remains conjecture. To render transparent how we arrived at our hypothesis, we disclose our sources and research results.

Presumably, Akelius plans to sell several thousand apartments in Hamburg and Berlin in a mega deal consisting of three steps. This is associated with massive tax avoidance and the transfer of profits to Canada.

Step 1: Akelius offsets losses against profits by shifting houses into GmbH & Co. KG companies while simultaneously booking „hidden reserves“ in a tax-saving way.

Step 2: Subsequently, Akelius sells these houses in a mega deal, without prior further investments or conversion into condominiums.

Step 3: As a result, Akelius drastically reduces its portfolio in Berlin and Hamburg and uses the profits to expand to North America, primarily Canada.

Akelius is a good example of all the shortcomings and deficiencies in tenant protection. First, Akelius buys large numbers of houses in share deals, thereby circumventing the district’s right of first purchase in milieu protection areas. Then Akelius systematically pursues the destruction of affordable housing by permanently shifting the apartments to the luxury segment. Next, Akelius either converts rental apartments into condominiums and sells them at top prices or resells them to another investor in a mega deal. None of this is in the interest of us tenants.

For cities like Berlin or Hamburg, Akelius is a massive problem. Akelius‘ exclusively profit-oriented business practice undermines administrative instruments for the protection of tenants and urban infrastructure. Due to the additional systematic tax avoidance in Akelius‘ business practices, cities and administrations are losing millions of euros that are necessary to keep a city running. That means, on the one hand, that Akelius is a burden on the social budgets of the cities, because Akelius increases rent prices, so that tenants are increasingly dependent on transfer payments in order to be able to pay their rising rents. And at the same time, Akelius uses tax tricks to refuse to pay taxes that cities need for their social spending.

Politically, the example of Akelius can be used to illustrate that large private listed real estate groups have far too much power. With their huge holdings and by purchasing and selling entire city districts, they are pursuing urban development policy, which ought to be the task of politics and the administration. There is an urgent need for effective instruments against these large profit-oriented corporations. Housing is a human right and falls within the scope of public welfare, which should not be run on a private-sector basis, but rather with the common good in mind.

Demands

We demand from politicians not to allow this Akelius mega-deal, but to transfer all affected houses into the municipal housing stock!

We demand the immediate stop of all current conversions and the prohibition of the conversion of rental apartments into owner-occupied apartments without exception!

We demand the extension of the municipal right of first purchase to areas that are currently not milieu protection areas and in particular the right to price-limited first purchase!

We demand the closing of all tax loopholes without exception, as well as the consistent examination of all Akelius share deals closed to date and the prosecution of demonstrably fictitious share deals!

We demand the consistent protection of tenants by means of a permanent rent cap and the socialization of Akelius within the framework of the campaign „Expropriate Deutsche Wohnen & Co.“

We demand the guarantee of all tenants‘ rights and the creation of transparency in the housing and financial market through the introduction of a housing and rent register!

We demand to finally put the human right to housing into practice!
